The Law on Traffic Safety has been changed

On 29. March 2019, the National Assembly of the Republic of the Serbia adopted the Law on Amendments to the Law on Road Traffic Safety (“Law”), published in the Official Gazette No. 23/2019 dated 29 March, 2019, effective the day after publishing in the Official Gazette, on 30 March, 2019.

Amendments to the Law refer to the addition of a provision enabling the owners of the motor vehicles intended for carrying out agricultural work to have valid registration permit until the change of the owner of the vehicle, holder of rights of use, change of residency of the owner of the vehicle to another registry area or other changes in the data entered in the registration permit. For registration to be valid the motor vehicle needs to have only certificate of technical validity. In addition, there has been a change in the provision that requires the owner of the motor vehicles to give accurate information to the competent authority, within eight days, on the person who is authorized to operate the vehicle and the evidence on the basis of which it can be for certain determined that the person operated the vehicle at a specified time. The evidence shall be considered a written statement certified by the competent authority by which the person confirms he was operating the vehicle at a specified time.

The main objective of these changes was that owners of the motor vehicles do not need to expose themselves to the costs of reregistration of vehicles, when the motor vehicle is intended only for use in performing agricultural works. The changes concerning the identification of the person who managed the vehicle at a certain time were made because, in practice, a large number of citizens provided information to the authorities about persons operating motor vehicles who were not available to the authorities, or for which it was not possible to determine whether they exist, or whether given address abroad was correct. With the obligation to provide evidence the legislator considers that the owners will now provide true information about the person who was driving the vehicle at a certain time.
