Law on Compulsory Traffic Insurance
The right to compensation based on motor third-party liability insurance policy belongs to every injured party, as well as to the perpetrator of the traffic accident if they have voluntary accident insurance for the driver and passengers in addition to the motor third-party liability insurance policy.
Motor third-party liability insurance is mandated by law and is required for every vehicle on the road. It covers the policyholder’s liability for damages caused to third parties and has the following two objectives:
- To protect the insured in the event of a traffic accident, and
- To protect the injured party by compensating for the damage caused by the traffic accident.
If there was another person in the vehicle that caused the traffic accident, besides the driver, that person has the right to compensation based on individual insurance, collective accident insurance policy, life insurance policy, etc.
If you suffer a traffic accident in which the perpetrator is unknown, you also have the right to compensation. In such situations, a fund established by the largest insurance companies in Serbia, which jointly bear the responsibility for compensation, is responsible. The same applies in the case of a traffic accident involving an unregistered vehicle.
Conditions for Traffic Accident Compensation
- The driver must have a valid driver’s license,
- The driver must not operate the vehicle under the influence of alcohol or illegal substances,
- The driver must not intentionally cause the traffic accident,
- The driver must not leave the accident scene without providing their personal and insurance information,
- The driver must not use the vehicle for purposes other than those stated in the insurance contract, and
- The vehicle involved in the traffic accident must be technically sound.
Traffic accidents are categorized as minor, severe, and fatal. In the case of a fatal traffic accident, compensation is paid to the close family members of the deceased.
Compensation for Emotional Distress
Based on the concluded automobile insurance, the insurance company, in addition to compensating for bodily injuries, also pays compensation for emotional distress. The following types of compensation are available:
- Compensation for primary and secondary fear experienced in the traffic accident,
- Compensation for emotional distress due to reduced life activities and/or disfigurement, and
- Compensation for emotional distress due to a fatal outcome.
The amount of compensation varies and depends on the type of emotional distress. The amount for primary and secondary fear is lower than the compensation for emotional distress due to reduced life activities and/or disfigurement, which in turn is lower than the compensation for a fatal outcome. Compensation for emotional distress due to death is only available to close relatives of the deceased (parents, legal and common-law partners, children, siblings, grandparents) if they lived in the same household and had a long-term living arrangement. Close family members have the right to, in addition to non-material damage compensation, also claim certain types of material damage compensation.
