Electricity

The Energy Act (“Official Gazette of the RS”, No. 145/2014, 95/2018 – other law and 40/2021 “EA“), regulates the following energy activities related to electricity:

  • Electricity generation;
  • combined production of electricity and heat;
  • transmission of electricity and management of the transmission system;
  • electricity distribution and distribution system management;
  • distribution of electricity and management of closed distribution system;
  • electricity supply;
  • wholesale supply of electricity;
  • management of the organized electricity market;
  • electricity storage.

 

It is important to note that the EA for performing certain energy activities (electricity production, combined electricity, and heat production) stipulates the obligation to have a license, and in addition for the construction of electricity production facilities, in certain cases, the EA stipulates the obligation to have an energy permit. These are obtained in proceedings before the Energy Agency of the Republic of Serbia or the Ministry of Mining and Energy. An energy permit is issued for each energy activity separately.

In this regard, experts from the STATT team will provide you with support throughout the process, from applying to issuing a license or energy permit solution.

Legal support includes the following services:

  • Providing legal advice;
  • drafting applications for the issuance of licenses and/or energy permits;
  • Representation in the procedure before the Energy Agency of the Republic of Serbia and/or the Ministry of Mining and Energy, as well as other services necessary for obtaining a license and/or energy permit.

Oil and natural gas

The EA regulates the following energy activities related to the production, transport, and distribution of oil and natural gas:

  • Storage and management of natural gas storage;
  • distribution and management of the natural gas distribution system;
  • natural gas supply;
  • wholesale supply of natural gas;
  • public supply of natural gas;
  • production of oil derivatives;
  • transport of oil by oil pipelines;
  • transport of oil derivatives by product pipelines;
  • transport of oil, oil derivatives, and biofuels by other forms of transport;
  • storage of oil, oil derivatives, and biofuels;
  • trade in oil, oil derivatives, biofuels, bioliquids, compressed natural gas, liquefied natural gas, and hydrogen;
  • trade in fuels outside the stations for the supply of means of transport;
  • filling of containers for liquefied petroleum gas, compressed and liquefied natural gas;
  • trade in motor and other fuels at stations for the supply of means of transport;
  • trade in fuel for vessels.

 

As in the case of electricity, so in the case of natural gas and oil, the EA stipulates the obligation to hold a license for certain energy activities, and the EA stipulates the obligation to hold an energy permit for the construction of certain facilities for production, transport, and distribution of oil and natural gas.

In addition, the EA stipulates that for the storage of oil, oil derivatives, and biofuels for own needs with a total capacity of over 5 tons and for the supply of own production facilities at its own stations for the supply of vehicles for which no license is issued, it obtains the consent issued by within 30 days from the date of submission of the request.

In this regard, as mentioned earlier, experts from the STATT team will provide you with legal support in the process of obtaining a license, energy permit, and the above-mentioned approvals.

Renewable energy

In addition to the above, we provide comprehensive legal services in the field of renewable energy sources, which is a particularly important area of ​​energy.

The regulation of renewable energy sources is separated and is in the Act on the Use of Renewable Energy Sources (“Official Gazette of RS”, No. 40/2021 “Act on the Use of RES“). The Act on the Use of RES recognizes the following types of power plants that use renewable energy sources:

  • Hydroelectric power plant;
  • biomass power plant;
  • biogas power plant;
  • wind farms;
  • solar power plant;
  • geothermal power plant;
  • power plant on biodegradable waste;
  • landfill gas power plant;
  • gas power plant from the municipal wastewater treatment plant;
  • a power plant that uses other renewable energy sources.

 

In this regard, STATT provides the necessary legal support in the process of construction and commissioning of facilities for the production of energy from renewable sources. These services include:

  • Obtaining all necessary permits, consents, licenses, etc.;
  • providing legal advice and legal interpretations of regulations;
  • mediation in negotiations;
  • representation before state bodies;
  • drafting and revision of contracts;
  • provision of other legal services.

 

It is important to note that the Act on the Use of RES regulates the system of incentives for the production of energy from renewable sources, as follows:

  • Through the system of market premiums and
  • through the feed-in tariff system.
