Changes to Civil Procedure Act
On 9 November 2018, the National Assembly of the Republic of Serbia adopted the amendments to the Civil Procedure Act, which is published in the Official Gazette of the Republic of Serbia No. 87/18 from 13 November 2018 which will come into force on 21 November 2018.
By these amendments to the Civil Procedure Act, it is stipulated that an individual who has obtained from the defendant an item or a right subject to litigation can step in such litigation instead of the defendant only if both parties agree about it, and on the other hand, if one has obtained an item or a right from the claimant, then one can join such litigation and replace an original claimant by operation of a written consent of such a claimant.
These amendments are enacted in order to improve selling of non-performing loans (NPLs) if case of existence of a litigation initiated by a bank.
